These terms and conditions outline the rules and regulations for the use of GEO API's Site and Services, so please carefully read them before using the Services provided by GEO API. You can only purchase Services from the Site if You are eligible to enter into a Contract. By accessing this Site We assume You accept these terms and conditions in full. Do not continue to use GEO API's Site and Services if You do not accept all of the terms and conditions stated on this page.Customer
The following terminology applies to these Terms and Conditions: “Customer”, “You” and “Your” refers to you, the person accessing this Service and accepting the Company’s terms and conditions. “The Company”, “We”, “Our” and “Us”, refers to our Company.
We reserve the right to change these Terms and Conditions at any given time. If You want to make sure that You are up to date with the latest changes, We advise You to frequently visit this page.
We do our best to verify the accuracy of any data We use on the Site, however We make no warranties in relation to the data accuracy. Services are provided on the Site on an "as is" and "as available" basis. Also We make no warranty that the Site will be uninterrupted or error-free. We therefore will not be responsible or liable to You for any loss or damage caused by any inaccuracies on the Site.
GEO API gives You a personal and non-exclusive license to use the Services. When using a free Plan of the Services, this license is strictly limited to Your personal, non-commercial use.
The Site may contain links to other websites. The content of the other sites is not operated by Us and We exclude all liability for third party content or third party websites.
You must co-operate with Us in all matters relating to the Service and provide Us with accurate information to perform the Service, if requested by Us. You are responsible for ensuring that the information You provided is accurate. If any of Your information changes please let Us know by updating Your account or contacting us.
We handle Your information with care and You are responsible for keeping Your login, password and api key confidential and set up a secure password to access the account. You are solely responsible for any activity using Your account, whether or not You authorized that activity. You should immediately notify Us of any unauthorized use of Your account or if Your email or password has been stolen. We will not be liable for any loss or damage arising from Your failure to comply.
Subscription Plan prices shown on the Site are in British Pounds and are exclusive of VAT. The price of a Subscription may change at the checkout if it is subject to any taxes applied in the country You reside.
We do our best to keep the details of Your Order and payment secure, but We will not be liable for any loss You may suffer if a third party gives an unauthorised access to any Personal Information You provide when placing an Order.
Steps to subscribe to our Service as follows:
- Choose the subscription plan You are interested in
- Fill in company details, payment details and press the 'Subscribe Now' button. It is Your responsibility to make sure that the data You provided is correct.
- You will receive the confirmation email with the description of the Plan You subscribed to. A Contract will be formed for the Subscription ordered only when You receive an email from us confirming the Order. You must check that the Order Confirmation is complete and accurate and inform Us immediately of any errors.
The first payment will be made immediately after subscribing to the Service. To renew the Subscription, payments will be taken automatically on the first day of new billing period. By using our Services you agree that the amount to renew the Subscription will be taken automatically from Your account.
You have a possibility to upgrade or downgrade the Subscription Plan. Please be advised that any amount for the remaining days of the previous Subscription will be deducted from the new Subscription Plan.
If Your payment fails We will notify You about this via email. If You fail to pay a recurring invoice within 14 days, We will downgrade the Subscription to the Free Plan.
The Contract will be automatically renewed for each following billing period, unless either party notifies the other party of termination, in writing, at least 14 days before the end of the Initial Subscription Period or any Renewal Period. In this case the Contract will terminate upon the expiry of the Initial Subscription Period or Renewal Period.
Either You or We may terminate the Contract without liability to other at any time by a written notice of termination to the other if that other: commits a serious breach of the Contract and the breach either cannot be fixed or is not fixed within 30 days of the written notice; or is subject to any step towards its bankruptcy or liquidation.
On the Contract termination the Customer account is downgraded to the Free Plan and the customer is not able to access the Paid Subscription any more.
If the Customer terminates the Contract, We shall not be obliged to refund any part of the Subscription Fees already paid by the Customer.
The Customer can terminate the Contract at any time by cancelling the Subscription Plan in the Dashboard or contacting us. The Customer should be aware that, unless it is Upgrade or Downgrade to another Paid Plan , the current Subscription Plan remains active and available for use until the end of the current billing period.
If the Customer deletes the Account, any use of the Service including any paid features set out on the Subscription Plan will become unavailable immediately.
You understand and agree that You use Our Service at Your own risk and the Service is provided "as is" and "as available" basis. We don't give any warranties or guaranties about the Service. To the maximum extent permitted by applicable law, We exclude all warranties relating to our Service and the use of it (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose).
We will use reasonable endeavours to make the Service available, reliable and accurate. However the Service might be occasionally interrupted for maintenance, upgrade, repairs or if there are failures of equipment or telecommunications links or other accidents beyond Our control . We cannot warrant or guarantee that:
- the Service meets Your requirements;
- the information obtained from use of the Service is reliable, accurate or complete;
- the Service will be uninterrupted and available at all times;
- the Service is free of errors or viruses;
- the loss of data will not occur;
We accept no liability for any damage or loss caused by Your reliance on the Service or usage of the Service. By using this Service You agree that neither Party shall be liable to the other for any loss of profits, revenue, business, goodwill, indirect or consequential loss or damage.
